This Prohibited & Restricted Items Policy (“Policy”) governs all items, goods, and materials that may be listed, advertised, or sold through the List A Sale platform (the “Service”). This Policy is incorporated into and forms part of the Terms of Service.
All users, including sellers, agree to comply with this Policy when using the Service. Sellers are solely responsible for ensuring that all items listed comply with applicable laws, regulations, and this Policy. Failure to comply may result in listing removal, account suspension, termination, or other enforcement actions at the sole discretion of List A Sale.
Sellers may not list, advertise, offer for sale, or otherwise distribute any item that is illegal, unsafe, regulated, restricted, or prohibited under applicable local, state, federal, or international laws, or that violates the terms or policies of List A Sale or its payment processors.
This includes, without limitation, items prohibited by payment processors such as Stripe. Sellers agree to comply with all applicable requirements and restrictions imposed by such payment processors, which may change from time to time.
List A Sale reserves the right to determine, in its sole and absolute discretion, whether any item is prohibited or restricted, including items not expressly listed in this Policy but deemed inappropriate or non-compliant.
The following categories of items are strictly prohibited from being listed or sold on the Service:
Items that are stolen, unlawfully obtained, counterfeit, or otherwise offered without legal ownership or authorization are strictly prohibited. Sellers must have clear legal title and the right to sell any item listed.
Items that are illegal or heavily regulated weapons or weapon-related materials are prohibited, including, but not limited to:
The listing or sale of illegal drugs, controlled substances, prescription-only medications, or drug paraphernalia is strictly prohibited.
Items that pose a safety, environmental, or health risk are prohibited, including hazardous chemicals, toxic substances, flammable materials, radioactive materials, or similar dangerous goods.
Products that have been recalled by manufacturers or regulatory agencies, or that are known to be unsafe or defective, may not be listed.
Items that infringe upon intellectual property rights, including counterfeit goods, unauthorized replicas, or items that violate trademarks, copyrights, or patents, are prohibited.
The listing of counterfeit currency, fraudulent financial instruments, or legal documents intended for misuse is prohibited. Collectible currency may be permitted only where legally allowed and accurately represented.
Items containing personal data or confidential information are prohibited. This includes, without limitation:
Human remains, body parts, biological specimens, or materials derived from humans or protected species are strictly prohibited.
The sale of live animals is not permitted on the Service.
Pornographic or explicit materials that are not presented as legitimate collectibles, or that violate applicable laws or community standards, are prohibited. Collectible publications may be permitted where legally allowed and accurately represented.
Items associated with violent crimes, serial offenders, or notorious criminal activity—including personal belongings, artwork, writings, or memorabilia intended to glorify or profit from such activity—are prohibited.
Tobacco products, nicotine products, vaping devices, and related paraphernalia are prohibited unless explicitly permitted by applicable law and approved by List A Sale.
Food, beverages, perishable goods, and consumable items intended for ingestion are not permitted on the Service.
Items made from or derived from endangered, threatened, or protected species, including ivory and certain taxidermy or wildlife products, are prohibited where restricted by law.
Items that are unlawfully obtained, misrepresented, or restricted cultural property—including Native American artifacts, burial items, or protected antiquities—may not be listed.
Listings for services, labor, digital-only goods, or non-tangible offerings are not permitted as marketplace listings on the Service.
Certain items may be permitted only where compliant with applicable laws and clearly disclosed by the Seller.
These may include collectible items, including adult publications or similar materials, provided that:
Sellers are solely responsible for ensuring compliance with all applicable regulations, including ensuring that items are lawful to sell and transfer in all relevant jurisdictions, including the seller’s and buyer’s locations where applicable.
List A Sale reserves the right to remove or restrict such listings at its sole discretion.
List A Sale recognizes that estate sales may include a wide range of personal property. However, Sellers remain responsible for ensuring that all items listed comply with this Policy and applicable laws. The presence of an item in an estate does not make it eligible for listing on the Service.
List A Sale reserves the right, in its sole and absolute discretion, to remove any listing that violates this Policy, restrict or terminate user accounts, limit platform functionality, report suspected illegal activity, or take any other action deemed necessary to protect the integrity of the Service.
Enforcement actions may include, without limitation:
Listings may be removed with or without prior notice. Repeated violations or attempts to circumvent this Policy may result in permanent account termination.
Any attempt to circumvent, misclassify, disguise, or otherwise avoid the restrictions set forth in this Policy shall constitute a violation and may result in enforcement action.
Sellers are solely responsible for ensuring that all listed items comply with this Policy and all applicable laws and regulations. Sellers agree to cooperate with any requests from List A Sale for additional information, documentation, or verification related to listed items. Failure to comply may result in immediate enforcement action.
List A Sale does not review, verify, or guarantee the legality, safety, authenticity, or compliance of any listed item. Users acknowledge that they engage with listings and transactions at their own risk.
List A Sale reserves the right to modify this Policy at any time. Updates will be effective upon posting. Continued use of the Service constitutes acceptance of any changes.
